These terms apply to your use of our website and to any purchase, membership or donation made through it. Please read them before using the website or placing an order. By using our website, you agree to these terms.
In these terms, "MOCA", "we" and "us" mean Museum of Chinese in Australia Limited (ABN 50 489 948 017), and "you" means the person using our website or placing an order.
Visiting the museum in person is subject to our conditions of entry, displayed at the museum, rather than to these terms.
1. Changes to these terms
We may update these terms from time to time. The current version is published on our website with the date it was last updated. Changes apply to your use of the website after the change takes effect, and to orders placed after that time. They do not change the terms that applied to an order we have already accepted.
2. Using our website
You may use our website for lawful purposes and in accordance with these terms. You must not:

We may suspend or withdraw access to the site, or to any part of it, where we reasonably consider it necessary.
3. Availability of the website
We do not warrant that the website will be available without interruption or free of errors. The website may be unavailable at times, including for maintenance, and we may change or withdraw features.
4. Our content and intellectual property
The content of our website, including text, images, audio, video, design and our name and logo, is owned by us or used with permission, and is protected by copyright and other laws.
Some material on our website relates to items in our collection or to material supplied by others, and rights in that material may be held by third parties. Nothing on our website transfers any rights to you.
You may view and print content from the website for your own personal, non-commercial use. Any other use, including copying, publishing, adapting or distributing our content, requires our written permission. Requests for permission should be directed to us using the details below.
5. Material you provide to us
If you provide us with content, such as images, recordings, stories or other material, you warrant that you are entitled to provide it and that doing so does not infringe the rights of any person.
Unless we agree otherwise in writing, you grant us permission to use that material for the purpose for which you provided it. Where material has been offered for our collection or for a project, any further use will be dealt with separately and in writing.
6. Accuracy of information
While we seek to publish accurate material, including historical and interpretive material, we do not warrant that the content of our website is accurate, complete or current. Content on the website is general in nature and does not constitute professional advice. Any reliance on it is at your own risk.
7. Orders
The display of a product on our website is an invitation to place an order and is not an offer to sell. A contract is formed only when we accept your order, by sending an order confirmation or by dispatching the goods.
We may decline or cancel an order before it is dispatched, including where the item is unavailable, where there has been an error in the price or description, or where we reasonably suspect fraud or misuse. If we cancel an order you have paid for, we will refund you in full.
You are responsible for the accuracy of the order and delivery details you provide.
8. Prices and payment
Prices are in Australian dollars and include GST unless stated otherwise. Delivery charges, where they apply, are shown before you complete your order.
We may change our prices at any time, but a change will not affect an order we have already accepted.
Payment is processed by a third party payment provider. Your payment is subject to that provider's terms as well as these terms.
9. Delivery and returns
Delivery, and returns and refunds, are dealt with in our Shipping Policy and our Refund and Returns Policy, which form part of these terms.
Risk in goods passes to you on delivery, or on collection if you have chosen to collect your order.
10. Memberships
Memberships are personal to the member and are not transferable. Membership benefits, and the terms on which they are offered, may change from time to time as our program changes. Where a change materially reduces the benefits of a current membership, we will notify the members affected.
Membership fees are not refundable except where required by law or where we agree otherwise.
11. Donations
MOCA is a charity registered with the Australian Charities and Not-for-profits Commission. Donations made through our website support our charitable purposes as a museum, including our exhibitions, programs, collection and the operation of the museum. Unless we have agreed with you in writing that a donation is for a particular purpose or appeal, we apply donations at our discretion across those purposes.
Donations are voluntary and, once processed, are generally not refundable. If you consider that a donation was made in error, please contact us and we will consider the request.
We issue receipts for donations. Whether a donation is tax deductible depends on your circumstances. You should obtain your own advice.
12. Third party websites and services
Our website may link to, or rely on, websites and services operated by others. We are not responsible for those websites or services, or for their content, terms or practices. Your use of those websites and services is a matter between you and the relevant operator.
13. Your rights under the Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures you are entitled to a replacement or refund, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they are not of acceptable quality and the failure is not a major failure.
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or under any other law that cannot be excluded. If any part of these terms would do so, it does not apply.
14. Liability
Subject to clause 13, and to the extent permitted by law:

Our liability for a failure to comply with a consumer guarantee, other than a guarantee that cannot be so limited, is limited to resupplying the goods or services, or paying the cost of resupply

We are not liable for indirect or consequential loss, or for loss of profit, revenue, data or opportunity

We are not liable for loss or damage caused by circumstances outside our reasonable control
15. Your responsibility
You are responsible for any loss we suffer that is caused by your breach of these terms, your misuse of our website, or material you provide to us that you were not entitled to provide. This does not apply to the extent the loss was caused by us.
16. Privacy
We handle personal information in accordance with our Privacy Policy, which forms part of these terms.
17. General
If any part of these terms is found to be unenforceable, the remainder continues to apply. A failure by us to enforce a right under these terms does not constitute a waiver of that right.
These terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that State.
