Museum of Chinese in Australia Limited (ABN 50 489 948 017) is committed to protecting personal information. This policy sets out how we handle personal information collected through our website, our shop, our events and our other activities. We are guided by the Australian Privacy Principles in the Privacy Act 1988 (Cth).

In this policy, "MOCA", "we" and "us" mean Museum of Chinese in Australia Limited.

The systems, platforms and service providers we use change from time to time. This policy describes how we handle personal information generally, rather than the arrangements of any particular provider or platform.

1. Dealing with us anonymously

Where it is lawful and practicable, you may deal with us anonymously or by pseudonym. Certain services, such as delivery of an order or the issue of a receipt, cannot be provided on that basis.

2. Information we collect

We collect personal information that is reasonably necessary for our functions and activities. It may include:

  • Contact and identity details, such as your name, email address, phone number and postal address
  • Transaction details relating to purchases, memberships, donations and event bookings
  • Correspondence and enquiries, and information you choose to provide to us

  • Applications to volunteer or work with us, including any checks required for a role
  • Images and recordings captured at our premises or at our events, as described in section 5

We generally collect personal information directly from you, when you make a purchase, join, donate, make a booking, subscribe, apply, contact us or visit. Some information is collected automatically when you use our website. We may also receive information from a third party where you have dealt with us through that party, such as a ticketing platform. Information is held in our own systems and in the systems of the service providers described in section 6.

We do not seek sensitive information unless you elect to provide it, or the law permits or requires us to collect it. If you elect not to provide information we request, we may be unable to provide the product, service or response sought.

3. How we use information

We use personal information for the purposes for which it was provided, for related purposes you would reasonably expect, and where you consent or the law permits or requires it. This includes supplying and supporting our products and services, administering memberships and donations, responding to enquiries, sending communications you have asked to receive, improving our website and services, managing our people and volunteers, keeping our premises and collection secure, and meeting our legal, financial and regulatory obligations.

We do not sell personal information.

4. Cookies and analytics

Our website uses cookies to operate essential functions, to retain preferences, and to assist us in understanding how the website is used. We also use third party analytics services, which collect information about visits to our website under their own terms. Most browsers permit cookies to be refused or deleted. Parts of our website may not function properly if cookies are disabled.

5. Photography, film and recording

We photograph, film and make recordings at our premises and at our events. We may use those recordings in our publications, website, social media, promotional material and archives. Closed circuit television operates at our premises for the security of visitors, staff and the collection.

Signage is displayed where recording is taking place at an event. If you do not wish to be recorded, please speak to a member of staff. If you have a concern about a published image of you, please contact us and we will consider your request.

If you provide us with images or recordings of other people, you confirm that you are entitled to do so for the purposes agreed with us.

6. Disclosure

We may disclose personal information to third party service providers engaged to perform functions on our behalf, including providers of online retail and point of sale systems, payment processing, communications and marketing platforms, website hosting and analytics, ticketing, information technology and file storage, delivery and logistics, and professional services such as accounting, audit and insurance.

We disclose only the information those providers require in order to provide their services to us, and we take reasonable steps to select providers that handle personal information appropriately. Each provider handles information under its own terms and privacy policy, which are set by that provider and may change from time to time. We do not control their practices, and this policy does not cover them.

We may also disclose personal information where required or authorised by law, or where reasonably necessary to establish, exercise or defend a legal claim.

7. Overseas disclosure

Some of our service providers store or process information outside Australia, and the locations may change from time to time. We take reasonable steps to select providers who protect personal information appropriately. However, overseas laws may differ from Australian privacy law and we may be unable to control or ensure how an overseas recipient handles information.

By providing personal information to us, you consent to its disclosure to overseas recipients on this basis, and you acknowledge that Australian Privacy Principle 8.1 does not apply to that disclosure.

8. Payments

Payment card details are submitted directly to our payment processor. We do not receive or store complete payment card numbers.

9. Communications and marketing

We send newsletters and similar communications to individuals who have requested them, and to individuals who would reasonably expect to receive communications from us about our work, where the law permits.

Each marketing message includes a means of opting out. We will action an opt out request within the period required by the Spam Act 2003 (Cth). Opting out does not affect communications we are required or entitled to send, such as order confirmations, receipts and membership notices.

10. Security

We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure.

No method of transmission or storage is completely secure. We cannot guarantee the security of information transmitted to us over the internet, and any transmission is at your own risk.

Nothing in this policy excludes, restricts or modifies any right or remedy you have under a law that cannot be excluded, including the Australian Consumer Law.

11. Third party websites

Our website may contain links to websites operated by others. We are not responsible for the content or privacy practices of those websites, and this policy does not apply to them.

12. Retention

We retain personal information for as long as it is needed for the purposes described in this policy, or for as long as we are required or entitled to retain it. When it is no longer needed, we take reasonable steps to destroy or de-identify it.

13. Access and correction

You may request access to the personal information we hold about you, and request correction of that information if it is inaccurate, out of date, incomplete, irrelevant or misleading. Requests should be made in writing using the contact details below and should include sufficient information for us to identify you and locate the information.

We will respond within a reasonable period. There are circumstances in which we may decline a request, including where the law permits or requires us to do so. If we decline a request, we will provide our reasons.

14. Complaints

If you consider that we have mishandled your personal information, please contact us using the details below, setting out the issue. We will investigate the matter and respond within a reasonable period.

15. Children

Our online shop, membership and donation services are intended for use by adults. We do not knowingly collect personal information online from a child without the involvement of a parent or guardian.

16. Changes to this policy

We may update this policy from time to time. The current version is published on our website with the date on which it was last updated. Continued use of our website and services after a change takes effect constitutes acceptance of the updated policy.

17. Governing law

This policy is governed by the laws of New South Wales, Australia.
